１ー３．組織的なものの一部としては、
この犯罪者は、警察官、検察官、裁判官です。そして弁護士らです。
まさに国家ぐるみの犯罪です。
こうした国家ぐるみの、不法な犯罪に対して、
国民や外国人は、成すすべが在りません。
もし、権力に対して抵抗するならばテロ行為しかありません。」
１－４．さらに、悪質なのは、この事件は不法な権力の行使による『適用法の誤り』ですが、
国家権力により、犯罪行為が握りつぶされています。
日本の司法制度で『適用法誤り』では、再審請求ができません。
しかし、事件にかかわった、警察官ら『特別公務員』の犯罪が証明されれば、再審請求ができます。
『特別公務員』らの犯罪は、なんら違反をしていないにもかかわらず『逮捕監禁を行い』（特別公務員職権乱用罪）、そして刑事罰を与える目的で、「検察へ送り（送検）』、「起訴」をしていますので、『虚偽国罪』に該当します。
それで、私は、刑期満了後、東京検察庁などへ、「告訴状」「告発状」を提出しますが、検察官らは『起訴独占権』を乱用して「告訴状」「告発状」を受理しません。
日本は、検察に『起訴独占権』を与えていますんで、検察官が受理しない限り、事件にすることができません。（不起訴であれば、検察審査会に審査請求ができますが、不受理では、検察審査会にも請求できません。）
１－５．日本国内での、添付資料のとおり、救済の方策をすべて行いましたが、尽きましたので、国連人権高等弁務官事務所に、提訴の書類を送りました。
しかし、日本は、「個人通報制度」を批准していないので、
提訴を受理してくれませんできません。
１ー６．それで、残る救済の道は、『国際刑事裁判所」（ICC）への提訴をするか、テロ行為により自力で救済をするしかありません。
私は、「国際刑事裁判所」（ICC）への提訴をする選択しました。
１－７．この事件は、外国人を対象とするので、対象者は地球上から来日する外国人すべてに及びます。とてつもない、広範囲に及びます。
このうち私は、2010年の中国人が受けた「入管法違反事件」および、「入管法違反事件」に関連して、私と中国人が受けた「入管法違反幇助事件」。そして、2014-2015年に、フィリッピン大使館を舞台にして発生した「入管法違反事件」と「入管法違反幇助事件」を対象として、「告訴」「告発」をしています。
2014-2015年に、フィリッピン大使館を舞台にして起きた「入管法違反事件」と「入管法違反幇助事件」は、まったく類似の犯罪です。
１－８． このほかにも、不法就労させられた外国人だけが、入管法違反で刑事処罰を受け国外退去となるが、不法就労させた事業者は、入管法で定める「不法就労助長罪」で何ら刑事処分を受けていません。
これは明らかに国際法『市民権と政治的権利に関する国際規約』に反しております。
つまり「人道上の犯罪」が常態化しています。
こうした処分は、日常茶飯事に起きておりますので、『人道に対する犯罪』をやめさせ
日本を法の下で統治される国にしなくてはなりません。
２．２０１０年の入管法違反、入管法違反幇助事件の要約
Lefco社の社長であった私（長野）は、中国人４人（正犯）に対し、２００９年１月頃までに、採用予定（内定）を出したが、２００８年秋のリーマンショックで、受注予定が激減したため、２００９年３月に、採用予定（内定）を取り消した。
Lefco社に就職できなかった中国人４人（正犯）は、大学卒業後も、学生時代にアルバイトで働いていた飲食店で、働いていて、２０１０年５月から６月に、入管法７０条の４（在留資格外活動による不法就労）で、逮捕された。
しかし、正犯を雇用した飲食店の、いずれの事業者も、入管法で定める７３の２条（不法就労助長罪）で逮捕されず、何の処分も受けていない。
私および採用を担当した、KinGungaku（金軍学）は、入管法７３の２条に規定する行為をしていないにも関わらず、
正犯に、雇用する意思がないのに「内容虚偽の雇用雇用書」を提供したので、正犯は容易に、「技術」や「人文国際」在留資格が得られた。
在留資格が得られたので、日本に在住できた。
日本に在住できたので、正犯は不法就労をすることができた。
よって、「内容虚偽の雇用契約者を提供した行為と不法就労との因果関係は明白である。」
としての刑法の幇助罪が適用され、２０１０年６月に逮捕され、７月に起訴された。
こういう論法は、日本では「風が吹けば桶屋が儲かる』という、「こじつけ』の論法です。勿論、法の論理に反しています。
私は、２０１１年4月に、懲役1年半の実刑、および罰金１００万円の刑事罰が下され、控訴するが２０１１年１０月に棄却され、最高裁判所に上告しますが、
「適用法誤りによる上告は刑事訴訟法上、審議対象外」として、
２０１２年２月棄却された。
そして、２０１２年３月、収監され、２０１３年３月に刑の満期で出所しました。
共犯とされた、KinGungaku（金軍学）は、罪を認めたので、
実刑でなく、執行猶予となり、２０１０年１０月末、中国へ強制送還された。
正犯4人は、２０１０年８月ころまでには、懲役１年半及び罰金刑となりましたが、
執行猶予で中国に強制送還された。
私および中国人の正犯４人やKinGungaku（金軍学）は、日本国憲法の第１４条（法の下の平等）第1項、「すべて国民は、法の下に平等であって、人種、信条、性別、社会的身分又は門地により、政治的、経済的又は社会的関係において、差別されない。」、
そして、日本国憲法の３１条、「何人も、法律の定める手続によらなければ、その生命若しくは自由を奪はれ、又はその他の刑罰を科せられない。」
に照らして、何の違反もしていません（後述）。
なお、日本国も批准している「市民権と政治的権利に関する国際規約」
第2条（1）（3）、
第4条（1）、
第5条（2）、
第9条(1)
(5)、
第13条、第14条（６）、
第15条（1）、
第16条、
第17条、
第26条、
に明確に反しており、なんら罪に問われることはなく冤罪です。
日本の司法制度では、「再審請求制度」がありますが、「適用法誤り」の理由では、請求できないが、事件にかかわった警察官などの犯罪が確定すると、再審請求ができます。
警察官や検察官、裁判官の犯罪は明らかです。その罪は、
何ら犯罪にならないのに、逮捕・監禁したので、刑法の「特別公務員職権乱用罪」です。
何ら犯罪にならないのに、虚偽の理由で刑罰を科す目的で起訴したので、刑法の「虚偽告訴罪」です。
それで、東京地方検察庁や警視庁などに、私に関するものは「告訴状」として、中国人やフィリッピン人に対するものは「告発状」として提出しますが、何度、提出しても、犯罪が明らかでないとして、受理しません。
日本は、検察官に「起訴独占権」を与えていますので、検察が「起訴状」「告発状」を受理しない限り、刑事事件として裁判ができません。
３．「何ら犯罪が思科されないし、犯罪行為をしていないとは」、
日本は、「不法就労」に対して、不法就労した外国人を「入管法」７０条「不法就労罪」で刑事処分し、
不法就労させた事業者を入管法７３の２条「不法就労助長罪」で、
両者を平等に刑事処分することで、
日本国憲法の「法の下での平等」や恣意的に外国人を処分することを禁じた「国際法」（市民権と政治的権利に関する国際規約）に反しないように立法しています。
しかし、実態は、不法就労させた事業者を「不法就労助長罪」で処分せず、
不法就労した外国人だけを「不法就労罪」で刑事処分し、国外追放にしています。
これは、外国人を恣意的に差別することを禁じた国際法に反しています。
日本国憲法の法の下での平等にも反しています。
不法就労させた「不法就労助長罪」で事業者を処分しないのであれば、
不法就労させられた外国人も、処分なし（無罪）が法の論理です。
そうであれば当然、如何なる、不法就労の幇助者もいないということです。
２０１０年に発生した事件では、もっと悪質な、犯罪行為をしました。
従来は不法就労させた事業者を「不法就労助長罪」で処分せず、
不法就労した外国人だけを「不法就労罪」で罰金刑にして国外追放していたのですが、
「不法就労助長罪」の事業者にかわる、
第三者の「幇助者」をでっち上げ、
平等に処分したように見せかけるため、第三者を刑事処分して、
不法就労した外国人を罰金刑でなく「懲役刑」にして国外追放したのです。
第三者とは、採用予定の正犯に雇用契約書を提供した私（長野）と共犯とされたKinGungaku「金軍学」です。
中国人の不法就労に対して、その幇助行為をしたとして、
国際法を遵守するため創設された、
不法就労に対する幇助行為や助長行為を規定した特別法である「不法就労助長罪」でなく、
不法にも、「内容虚偽の雇用契約書」を提供したから、
在留資格が容易に得られた。それで日本におられた。
日本におられたから不法就労ができた。との因果関係で、
一般法である刑法の「幇助罪」を乱用しました。
４．こうした事件は、私たちだけでなく、私の知る限り、２０１４年、２０１５年にはフィリピン大使館職員や外交官も、同様の不法な論理で「幇助罪」が適用され刑事処分されております。
もはや、日常的に、国際法違反による「人道上の犯罪』が行われていますので、緊急に対応をお願いします。
４－１．不法就労に対する幇助罪は、
特別法にあたる、入管法の７３の２条「不法就労助長罪」で規定されています。
正犯や警察官、検察官も認めるように、私やKinGungaku（金軍学）は、
「不法就労助長罪」に規定する行為はしていません。
※起訴状に書かれている「訴因」は、
入管法第２２の４条の４に記載する、行政処分である、在留資格の取消行為に対する、
幇助行為を指していますので、適用法違反です。
正犯を雇用した事業者は何れも、処分なしで、入管法が規定する「不法就労助長罪」で処分されていません。
そうであれば、雇用され不法就労させられた正犯も、処分なしが、法の下での平等です。したがって無罪です。
そうであれば、私を含め、不法就労に対する、如何なる幇助者も存在しないということです。
４－2．次に、刑法の「幇助罪」適用の因果関係として、「内容虚偽の雇用契約書」の提供が、在留資格の取得を容易にしたと言いますが、不当です。
在留資格を容易に取得させたというが、在留資格の付与条件は法律で規定されておらず、
付与条件は未公開で、法務大臣が裁量で付与するものであり、
在留資格を容易にしたとは言えません。
仮に、「内容虚偽の雇用契約書」で在留資格を得たとしても、
入管法２２の４条の４「在留資格取消」で規定するとおり、不法就労とは別個のものです。
仮に「内容虚偽の雇用契約書」で法務大臣より技術や人文国際の在留資格を得たとしても、技術や人文国際の在留資格の範囲で働いていれば、不法就労（資格外活動）にならないことは自明の理です。したがって在留資格の取得と不法就労とは何ら関係のないものす。
彼等が不法就労者になったのは、働く資格のない在留資格の外国人を、雇用して、働かせた事業者の責任であることは自明の理であります。
４ー３．2014－2015年のフィリッピン大使館事件でも、証明されるように、
相変わらず、不法に雇用した事業者は処分されずに、
不法に雇用された外国人だけが、恣意的に刑事処分されていますので、緊急に救済して下さい。
４－４．この提訴の対象となる犯罪者は、添付の、
「告訴状』および「告発状』に、記載する者です。
数多くの、警察官、検察官、裁判官ら、
そして弁護士らです。
日本の司法の実体を象徴しています！
それほど深刻な、「人道上の犯罪』です。

この問題は、「人道上の問題」です。
国家ぐるみの犯罪ですから、法務大臣でも解決しません。
多くの国会議員にも手紙やメールを出しましたが、
問題は、把握したが、動けないようです。
国会議員でも、
検察官や裁判官の犯罪を糾弾するには勇気が必要です。
脛に、傷を持っていますから、
司法の権力者と争いたくないようです。
日本の国会議員は「正義」がありません。
日本に「武士道」の心をもった、「侍」はいません。
それは、どうしてかは、考えてください。
わからなければ、教えます・・・・
国際刑事裁判所は、国際法に基づいて、
「粛々」と取り上げてください。
