次に、刑法の「幇助罪」適用の因果関係として、「内容虚偽の雇用契約書」の提供が、
在留資格の取得を容易にしたと言いますが、不当です。
在留資格を容易に取得させたというが、在留資格の付与条件は法律で規定されておらず、
付与条件は未公開で、法務大臣が裁量で付与するものであり、在留資格を容易にしたとは言えません。
仮に、「内容虚偽の雇用契約書」で在留資格を得たとしても、
入管法２２の４条の４「在留資格取消」で規定するとおり、不法就労とは別個のものです。
仮に「内容虚偽の雇用契約書」で法務大臣より技術や人文国際の在留資格を得たとしても、
技術や人文国際の在留資格の範囲で働いていれば、
不法就労（資格外活動）にならないことは自明の理です。
したがって在留資格の取得と不法就労とは何ら関係のないものす。
この不法な適用法誤りを指摘すると、
警察官は「一般論で罪を認めろ」と言って、自白を強要します。
検察官は、「私は偉いのです。
罪を認めれば、罰金刑。罪認めなければ刑務所に送る」と言って自白を強要します。
これが、日本の司法の事実です。助けてください！！
