【第7章】国内の救済手続きにおける機能不全

刑期満了による釈放後、私は2013年にフィリピン大使館関係者が私と全く同じ構図の不当な摘発（入管法違反）に遭っていることを知りました。

私はこの構造的冤罪を正すため、東京地方検察庁、東京高等検察庁、最高検察庁に対して「告訴状」および「告発状」を提出しました。しかし、検察はこれらをすべて「不受理」という形で門前払いしました。「不起訴」であれば検察審査会へ不服を申し立てる道がありますが、「不受理」にすることで、法的に対抗する手段すら奪われたのです。

また、政党や国会議員、弁護士会（日弁連）にもこの司法の歪みを訴えましたが、保身や知識不足からか、すべて無視または拒絶されました。大手政党の顧問弁護士ですら「正犯が有罪なら幇助も成立する」という思考停止の回答に終始し、日本の法秩序の崩壊を痛感せざるを得ませんでした。

検察・警察・裁判所によるこの一連の行為は、「特別公務員職権乱用罪」および「虚偽告訴罪」に該当する不法行為です。検察が職権でこれらの告訴・告発を隠蔽し続けているため、時効のカウントは停止していると解釈すべきです。

【第8章】再審請求への意志とアメリカへの期待

刑事訴訟法上、単なる「適用法の誤り」は再審請求の理由から除外されています。しかし、当時の捜査・裁判に関わった「公務員の犯罪」が立証されれば、再審の扉は開かれます。根拠なき不当逮捕（職権乱用）と、無実の者を罪人に仕立て上げた罪（虚偽告訴）を追及し、検察自らが非を認めて再審請求を行うべきです。事件から15年が経過しましたが、私は決して諦めません。

この日本の閉鎖的な司法システムを打破できる外部の力は、米国をおいて他にありません。トランプ氏は前大統領在任時、私に対し「満足のいく方法で解決する」との趣旨の署名入り返信をくれました。私はこの約束の実現を強く期待しています。

[Chapter 1] Case Overview

Autumn 2008: My company (where I serve as President) executed an employment contract with Chinese students holding student visas, promising to hire them upon their university graduation the following spring.

Late 2008: The Lehman Brothers bankruptcy triggered a global financial crisis, resulting in the abrupt cancellation of our upcoming system development projects.

2009: Due to the severe economic downturn, we were forced to rescind the job offers. Consequently, the graduated students had no choice but to continue working at the restaurants where they had been employed part-time during their studies.

May 2010: These former Chinese students were arrested for "Activities Other Than Those Permitted Under the Status of Residence" (Violation of Article 70 of the Immigration Control Act).

June 2010: I and our Chinese recruitment manager were also arrested. The charge brought against us was "Aiding and Abetting" (under the Penal Code) their unauthorized technical employment.

The Prosecution’s Logic: The prosecution asserted that our prior issuance of the employment contract constituted a "false document," which subsequently aided their unauthorized work.

[Chapter 2] Fatal Flaws in Judicial Interpretation

This indictment and subsequent judgment completely disregard fundamental legal principles, relying on an entirely arbitrary interpretation of the law.

Under Article 22-4, Paragraph 1, Item 4 of the Immigration Control Act at that time, submitting false documents merely granted the Minister of Justice the authority to revoke a residency status as an administrative disposition (leading to deportation). The act of submitting false documents itself was not codified as a criminal offense. Logically, one cannot be convicted of "aiding and abetting" an act that is not a crime in itself.

The court’s reasoning followed a convoluted chain of causality:

A residency status was obtained via a false employment contract.

The individuals resided in Japan based on that status.

Consequently, they engaged in unauthorized part-time work.

Therefore, the issuer of the initial contract aided and abetted the unauthorized work.

This is a far-fetched, flawed causal link that completely violates the principles of modern legal logic.

[My Argument]

Confusion of Administrative Dispositions and Criminal Penalties: The Immigration Control Act explicitly designates the consequences for false documentation as administrative measures (revocation of status and deportation). The legal process concludes there.

Absence of a Principal Offender: The actual employers of the restaurants where the students worked were never prosecuted for "Encouraging Illegal Employment" (Article 73-2 of the Immigration Control Act). Under the principle of equality under the law, it is a legal contradiction to punish us for aiding and abetting when the principal employers themselves were not prosecuted.

This same flawed legal doctrine was later improperly applied to diplomats and embassy staff.

Part 3: A New Business Model via Special Economic Zones

I propose the establishment of "Special Economic Zones" designed to accept refugees and migrants as "temporary migrant workers," with their residency restricted to these designated zones.

This framework offers a dual benefit: advanced nations secure low-cost labor to drive economic growth, while migrants receive human dignity, secure jobs, and free access to housing, food, healthcare, and education.

第2部：「入管法違反事件」【平日版】

日本の司法制度および入管行政には、国際社会の基準から見ても極めて重大な人権侵害の疑いがあります。私は自身の経験を通じて、日本の「法治国家」としてのあり方に強い疑問を投げかけます。

まずは、2010年に私が「入管法違反幇助（ほうじょ）罪」という冤罪に巻き込まれた経緯についてご一読ください。

【第1章】事件の概要

2008年秋： 私が経営する会社は、留学ビザで在留中だった中国人学生との間で、翌春の大学卒業後の採用を約束する「雇用契約書」を交付しました。

2008年末： リーマンショックが発生し、翌年以降のシステム開発案件が次々とキャンセルされました。

2009年： 経営環境の悪化により、やむを得ず該当の中国人学生の雇用を取り消しました。そのため、彼らは卒業後も学生時代からのアルバイト（飲食店）を継続せざるを得なくなりました。

2010年5月： この中国人元学生らが「在留資格外活動（入管法第70条違反）」で逮捕されました。

2010年6月： 私と採用担当者も逮捕されました。容疑は、彼らの資格外活動に対する「刑法上の幇助（手助け）罪」でした。

逮捕の論理： 検察側は、「過去に交付した雇用契約書が虚偽であり、それが結果的に彼らの不法就労を助けた」と主張したのです。

【第2章】判決における法解釈の致命的な誤り

この起訴および判決は、法律の原則を無視した極めて恣意的なものです。

当時の入管法第22条の4第4号の規定では、虚偽の書類を提出して在留資格を得た場合、法務大臣は「行政処分」としてその資格を取り消すことができると定めているに過ぎません。つまり、虚偽書類の提出そのものは、刑罰の対象となる「犯罪」とは規定されていません。犯罪ではない行為を「幇助」したという理屈は、法的に成立しません。

判決の論法は以下のようなものです。

虚偽の雇用契約書で在留資格を取得した。

その資格で日本に在留した。

在留した結果、アルバイト（資格外活動）を行った。

したがって、最初の契約書を出した者が資格外活動を幇助した。

これは「風が吹けば桶屋が儲かる」式の強引な因果関係であり、近代法の論理に完全に反しています。

【私の主張】

行政処分と刑事罰の混同： 入管法は、虚偽書類に対する措置を行政処分（在留資格の取消・強制送還）と定めており、それで手続きは完結します。

正犯なき幇助の矛盾： 彼らが働いていた飲食店の雇用主は、入管法第73条の2（不法就労助長罪）で処罰されていません。正犯（実際の雇用主）が処罰されていない以上、法の下の平等の原則に照らし、私たちが処罰されるのは法理的に異常です。

同様の不当な論理は、のちに外交官や大使館職員に対しても適用されることになります。

[Chapter 3] Appeals to the International Community and Legal Contradictions

Article 31 of the Constitution of Japan guarantees due process, stating that no person shall be deprived of life or liberty except according to procedure established by law (the principle of legality). Yet, the prosecution in this case forcefully misapplied administrative provisions to fit the Penal Code’s definition of aiding and abetting. This demonstrates a severe lack of legal competence and constitutes an abuse of official authority.

Following our case in 2010 and a nearly identical incident involving Philippine Embassy staff in 2013, international criticism intensified against Japan's arbitrary enforcement of the law.

Consequently, the Japanese government amended the Immigration Control Act in December 2016 (effective January 2017) to explicitly criminalize the act of "providing false employment contracts."

This statutory amendment is irrefutable proof that no such crime existed under the previous law when we were charged, meaning we were entirely innocent. Article 39 of the Constitution strictly prohibits retroactive punishment (ex post facto laws). Despite this clear legal reality, the government has offered no apology, restoration of honor, or compensation.

[Chapter 5] Petitions to International Organizations

Following my release, I sought redress from foreign embassies in Japan, the Office of the United Nations High Commissioner for Human Rights (OHCHR), and the International Criminal Court (ICC).

An ambassador from an African nation advised me that while diplomatic ties prevented an official state protest, they could engage networks within the ICC. I believe this international pressure ultimately forced the 2016 statutory amendment.

The number of foreign nationals—including Chinese, Korean, Filipino, and American citizens—who fall victim to such arbitrary legal interpretations in Japan is estimated to be in the tens or hundreds of thousands. This is an alarming crisis that the international community cannot ignore.

【第3章】国際社会への告発と法改正の事実

日本国憲法第31条は、適正な法律の定める手続きによらなければ刑罰を科せられない（罪刑法定主義）と定めています。しかし、本件で検察が用いた論理は、行政処分である入管法の規定を、刑法の幇助罪へと強引に結びつけたものであり、法的な専門知識を著しく欠いた職権乱用と言わざるを得ません。

実際、私どもの事件（2010年）や、その後のフィリピン大使館関係者の事件（2013年）に対し、国際社会から日本の不当な法運用への批判が高まりました。

その結果、日本政府は2016年12月に入管法を改正（2017年1月施行）し、ようやく「虚偽の雇用契約書を提供する行為」を処罰できる明確な規定を作りました。

この法改正こそが、「それ以前の法律では処罰できなかった（＝私たちは無罪であった）」ことの動かぬ証拠です。憲法第39条は法律の遡及処罰（過去に遡って罪に問うこと）を禁止しています。それにもかかわらず、政府からの謝罪や名誉回復、賠償はいまだに行われていません。

【第5章】国際機関へのアプローチ

釈放後、私は在日外国大使館や国連人権高等弁務官事務所（OHCHR）、国際刑事裁判所（ICC）へ救済を求めました。

あるアフリカ諸国の大使からは、「政府間の援助関係から表立った抗議は難しいが、ICCのネットワークを通じて動くことはできる」との合理的な助言も得ました。こうした国際的な圧力が、2016年の入管法改正に繋がったと考えています。

日本国内でこのような恣意的な法解釈の犠牲になっている外国人は、中国人、韓国人、フィリピン人、アメリカ人など、数万人から数十万人に上る可能性があります。これは看過できない異常な事態です。

Japan’s judicial system and immigration administration involve severe human rights violations that challenge international standards. Through my own experience, I strongly question Japan's status as a constitutional state governed by the rule of law.

[Chapter 1] Case Overview

Autumn 2008: My company (where I serve as President) executed an employment contract with Chinese students holding student visas, promising to hire them upon their university graduation the following spring.

Late 2008: The Lehman Brothers bankruptcy triggered a global financial crisis, resulting in the abrupt cancellation of our upcoming system development projects.

2009: Due to the severe economic downturn, we were forced to rescind the job offers. Consequently, the graduated students had no choice but to continue working at the restaurants where they had been employed part-time during their studies.

May 2010: These former Chinese students were arrested for "Activities Other Than Those Permitted Under the Status of Residence" (Violation of Article 70 of the Immigration Control Act).

June 2010: I and our Chinese recruitment manager were also arrested. The charge brought against us was "Aiding and Abetting" (under the Penal Code) their unauthorized technical employment.

The Prosecution’s Logic: The prosecution asserted that our prior issuance of the employment contract constituted a "false document," which subsequently aided their unauthorized work.

[Chapter 2] Fatal Flaws in Judicial Interpretation

This indictment and subsequent judgment completely disregard fundamental legal principles, relying on an entirely arbitrary interpretation of the law.

Under Article 22-4, Paragraph 1, Item 4 of the Immigration Control Act at that time, submitting false documents merely granted the Minister of Justice the authority to revoke a residency status as an administrative disposition (leading to deportation). The act of submitting false documents itself was not codified as a criminal offense. Logically, one cannot be convicted of "aiding and abetting" an act that is not a crime in itself.

The court’s reasoning followed a convoluted chain of causality:

A residency status was obtained via a false employment contract.

The individuals resided in Japan based on that status.

Consequently, they engaged in unauthorized part-time work.

Therefore, the issuer of the initial contract aided and abetted the unauthorized work.

This is a far-fetched, flawed causal link that completely violates the principles of modern legal logic.

[My Argument]

Confusion of Administrative Dispositions and Criminal Penalties: The Immigration Control Act explicitly designates the consequences for false documentation as administrative measures (revocation of status and deportation). The legal process concludes there.

Absence of a Principal Offender: The actual employers of the restaurants where the students worked were never prosecuted for "Encouraging Illegal Employment" (Article 73-2 of the Immigration Control Act). Under the principle of equality under the law, it is a legal contradiction to punish us for aiding and abetting when the principal employers themselves were not prosecuted.

This same flawed legal doctrine was later improperly applied to diplomats and embassy staff.

I propose the establishment of "Special Economic Zones" designed to accept refugees and migrants as "temporary migrant workers," with their residency restricted to these designated zones.

【第1章】事件の概要

2008年秋： 私が経営する会社は、留学ビザで在留中だった中国人学生との間で、翌春の大学卒業後の採用を約束する「雇用契約書」を交付しました。

2008年末： リーマンショックが発生し、翌年以降のシステム開発案件が次々とキャンセルされました。

2009年： 経営環境の悪化により、やむを得ず該当の中国人学生の雇用を取り消しました。そのため、彼らは卒業後も学生時代からのアルバイト（飲食店）を継続せざるを得なくなりました。

2010年5月： この中国人元学生らが「在留資格外活動（入管法第70条違反）」で逮捕されました。

2010年6月： 私と採用担当者も逮捕されました。容疑は、彼らの資格外活動に対する「刑法上の幇助（手助け）罪」でした。

逮捕の論理： 検察側は、「過去に交付した雇用契約書が虚偽であり、それが結果的に彼らの不法就労を助けた」と主張したのです。

【第2章】判決における法解釈の致命的な誤り

この起訴および判決は、法律の原則を無視した極めて恣意的なものです。

当時の入管法第22条の4第4号の規定では、虚偽の書類を提出して在留資格を得た場合、法務大臣は「行政処分」としてその資格を取り消すことができると定めているに過ぎません。つまり、虚偽書類の提出そのものは、刑罰の対象となる「犯罪」とは規定されていません。犯罪ではない行為を「幇助」したという理屈は、法的に成立しません。

判決の論法は以下のようなものです。

虚偽の雇用契約書で在留資格を取得した。

その資格で日本に在留した。

在留した結果、アルバイト（資格外活動）を行った。

したがって、最初の契約書を出した者が資格外活動を幇助した。

これは「風が吹けば桶屋が儲かる」式の強引な因果関係であり、近代法の論理に完全に反しています。

【私の主張】

行政処分と刑事罰の混同： 入管法は、虚偽書類に対する措置を行政処分（在留資格の取消・強制送還）と定めており、それで手続きは完結します。

正犯なき幇助の矛盾： 彼らが働いていた飲食店の雇用主は、入管法第73条の2（不法就労助長罪）で処罰されていません。正犯（実際の雇用主）が処罰されていない以上、法の下の平等の原則に照らし、私たちが処罰されるのは法理的に異常です。

[Chapter 1] Case Overview

Autumn 2008: My company (where I serve as President) executed an employment contract with Chinese students holding student visas, promising to hire them upon their university graduation the following spring.

Late 2008: The Lehman Brothers bankruptcy triggered a global financial crisis, resulting in the abrupt cancellation of our upcoming system development projects.

2009: Due to the severe economic downturn, we were forced to rescind the job offers. Consequently, the graduated students had no choice but to continue working at the restaurants where they had been employed part-time during their studies.

May 2010: These former Chinese students were arrested for "Activities Other Than Those Permitted Under the Status of Residence" (Violation of Article 70 of the Immigration Control Act).

June 2010: I and our Chinese recruitment manager were also arrested. The charge brought against us was "Aiding and Abetting" (under the Penal Code) their unauthorized technical employment.

The Prosecution’s Logic: The prosecution asserted that our prior issuance of the employment contract constituted a "false document," which subsequently aided their unauthorized work.

[Chapter 2] Fatal Flaws in Judicial Interpretation

This indictment and subsequent judgment completely disregard fundamental legal principles, relying on an entirely arbitrary interpretation of the law.

Under Article 22-4, Paragraph 1, Item 4 of the Immigration Control Act at that time, submitting false documents merely granted the Minister of Justice the authority to revoke a residency status as an administrative disposition (leading to deportation). The act of submitting false documents itself was not codified as a criminal offense. Logically, one cannot be convicted of "aiding and abetting" an act that is not a crime in itself.

The court’s reasoning followed a convoluted chain of causality:

A residency status was obtained via a false employment contract.

The individuals resided in Japan based on that status.

Consequently, they engaged in unauthorized part-time work.

Therefore, the issuer of the initial contract aided and abetted the unauthorized work.

This is a far-fetched, flawed causal link that completely violates the principles of modern legal logic.

[My Argument]

Confusion of Administrative Dispositions and Criminal Penalties: The Immigration Control Act explicitly designates the consequences for false documentation as administrative measures (revocation of status and deportation). The legal process concludes there.

Absence of a Principal Offender: The actual employers of the restaurants where the students worked were never prosecuted for "Encouraging Illegal Employment" (Article 73-2 of the Immigration Control Act). Under the principle of equality under the law, it is a legal contradiction to punish us for aiding and abetting when the principal employers themselves were not prosecuted.

This same flawed legal doctrine was later improperly applied to diplomats and embassy staff.

Part 3: A New Business Model via Special Economic Zones

I propose the establishment of "Special Economic Zones" designed to accept refugees and migrants as "temporary migrant workers," with their residency restricted to these designated zones.

This framework offers a dual benefit: advanced nations secure low-cost labor to drive economic growth, while migrants receive human dignity, secure jobs, and free access to housing, food, healthcare, and education.

[Chapter 1] Case Overview

Autumn 2008: My company (where I serve as President) executed an employment contract with Chinese students holding student visas, promising to hire them upon their university graduation the following spring.

Late 2008: The Lehman Brothers bankruptcy triggered a global financial crisis, resulting in the abrupt cancellation of our upcoming system development projects.

2009: Due to the severe economic downturn, we were forced to rescind the job offers. Consequently, the graduated students had no choice but to continue working at the restaurants where they had been employed part-time during their studies.

May 2010: These former Chinese students were arrested for "Activities Other Than Those Permitted Under the Status of Residence" (Violation of Article 70 of the Immigration Control Act).

June 2010: I and our Chinese recruitment manager were also arrested. The charge brought against us was "Aiding and Abetting" (under the Penal Code) their unauthorized technical employment.

The Prosecution’s Logic: The prosecution asserted that our prior issuance of the employment contract constituted a "false document," which subsequently aided their unauthorized work.

[Chapter 2] Fatal Flaws in Judicial Interpretation

This indictment and subsequent judgment completely disregard fundamental legal principles, relying on an entirely arbitrary interpretation of the law.

Under Article 22-4, Paragraph 1, Item 4 of the Immigration Control Act at that time, submitting false documents merely granted the Minister of Justice the authority to revoke a residency status as an administrative disposition (leading to deportation). The act of submitting false documents itself was not codified as a criminal offense. Logically, one cannot be convicted of "aiding and abetting" an act that is not a crime in itself.

The court’s reasoning followed a convoluted chain of causality:

A residency status was obtained via a false employment contract.

The individuals resided in Japan based on that status.

Consequently, they engaged in unauthorized part-time work.

Therefore, the issuer of the initial contract aided and abetted the unauthorized work.

This is a far-fetched, flawed causal link that completely violates the principles of modern legal logic.

[My Argument]

Confusion of Administrative Dispositions and Criminal Penalties: The Immigration Control Act explicitly designates the consequences for false documentation as administrative measures (revocation of status and deportation). The legal process concludes there.

Absence of a Principal Offender: The actual employers of the restaurants where the students worked were never prosecuted for "Encouraging Illegal Employment" (Article 73-2 of the Immigration Control Act). Under the principle of equality under the law, it is a legal contradiction to punish us for aiding and abetting when the principal employers themselves were not prosecuted.

This same flawed legal doctrine was later improperly applied to diplomats and embassy staff.

I propose the establishment of "Special Economic Zones" designed to accept refugees and migrants as "temporary migrant workers," with their residency restricted to these designated zones.

【第1章】事件の概要

2010年5月： この中国人元学生らが「在留資格外活動（入管法第70条違反）」で逮捕されました。

2010年6月： 私と採用担当者も逮捕されました。容疑は、彼らの資格外活動に対する「刑法上の幇助（手助け）罪」でした。

逮捕の論理： 検察側は、「過去に交付した雇用契約書が虚偽であり、それが結果的に彼らの不法就労を助けた」と主張したのです。

【第2章】判決における法解釈の致命的な誤り

この起訴および判決は、法律の原則を無視した極めて恣意的なものです。

当時の入管法第22条の4第4号の規定では、虚偽の書類を提出して在留資格を得た場合、法務大臣は「行政処分」としてその資格を取り消すことができると定めているに過ぎません。つまり、虚偽書類の提出そのものは、刑罰の対象となる「犯罪」とは規定されていません。犯罪ではない行為を「幇助」したという理屈は、法的に成立しません。

判決の論法は以下のようなものです。

虚偽の雇用契約書で在留資格を取得した。

その資格で日本に在留した。

在留した結果、アルバイト（資格外活動）を行った。

したがって、最初の契約書を出した者が資格外活動を幇助した。

これは「風が吹けば桶屋が儲かる」式の強引な因果関係であり、近代法の論理に完全に反しています。

【私の主張】

行政処分と刑事罰の混同： 入管法は、虚偽書類に対する措置を行政処分（在留資格の取消・強制送還）と定めており、それで手続きは完結します。

正犯なき幇助の矛盾： 彼らが働いていた飲食店の雇用主は、入管法第73条の2（不法就労助長罪）で処罰されていません。正犯（実際の雇用主）が処罰されていない以上、法の下の平等の原則に照らし、私たちが処罰されるのは法理的に異常です。

同様の不当な論理は、のちに外交官や大使館職員に対しても適用されることになります。

This indictment and subsequent judgment completely disregard fundamental legal principles, relying on an entirely arbitrary interpretation of the law.

Under Article 22-4, Paragraph 1, Item 4 of the Immigration Control Act at that time, submitting false documents merely granted the Minister of Justice the authority to revoke a residency status as an administrative disposition (leading to deportation). The act of submitting false documents itself was not codified as a criminal offense. Logically, one cannot be convicted of "aiding and abetting" an act that is not a crime in itself.

The court’s reasoning followed a convoluted chain of causality:

A residency status was obtained via a false employment contract.

The individuals resided in Japan based on that status.

Consequently, they engaged in unauthorized part-time work.

Therefore, the issuer of the initial contract aided and abetted the unauthorized work.

This is a far-fetched, flawed causal link that completely violates the principles of modern legal logic.

[My Argument]

Confusion of Administrative Dispositions and Criminal Penalties: The Immigration Control Act explicitly designates the consequences for false documentation as administrative measures (revocation of status and deportation). The legal process concludes there.

Absence of a Principal Offender: The actual employers of the restaurants where the students worked were never prosecuted for "Encouraging Illegal Employment" (Article 73-2 of the Immigration Control Act). Under the principle of equality under the law, it is a legal contradiction to punish us for aiding and abetting when the principal employers themselves were not prosecuted.

This same flawed legal doctrine was later improperly applied to diplomats and embassy staff.

I propose the establishment of "Special Economic Zones" designed to accept refugees and migrants as "temporary migrant workers," with their residency restricted to these designated zones.
