日本の人権問題に関心を持って戴いて、本当にうれしいです。
日本に入国する多くの外国人が、日本政府関係者の人権侵害にあっています。

お電話では、私が直接、把握している中国人とフィリッピン人の話をしました。
中国人とフィリッピン人だけでなく、多くの外国人が泣いていると思います。

どこの国でも、、合法的な入国者の不法就労くらいでは、
行政処分としての国外退去です。

しかし、日本では、検察官の独断で、不公平で恣意的な扱いがされています。
日本では、在留資格外で働くことはできません。
それで、資格外で働いた外国人に対しては「入管法」で処分が定められています。

不法就労は、売春と同じで、外国人だけでは不法就労できません。

働く資格のない外国人の不法就労に対しては、
「不法就労罪（在留資格外活動）で罰金及び懲役3年以下の刑事処分をする規定です。

そして、働く資格のない外国人を雇用した事業者には、
「不法就労助長罪」で罰金及び懲役3年以下の刑事処分をする規定です。

しかし、現実は、事業者はお咎めなしの無罪で、
恣意的に外国人だけを罰金刑で刑事処分しています。
この事実だけでも、国際法に明確に違反しています。

しかし、私が告訴・告発しているケースは、もっと悪質です。

私2008年秋、日本に留学ビザで在日している中国人4人を、2009年4月に採用する雇用契約をしました。

しかし、2008年秋に、「リーマンショック」が発生したので、
採用予定の中国人4人を採用しませんでした。

4人は、既に私の会社から提供をうけた雇用契約書を添付して
在留資格の更新をしていました。

それで4人は、学生時代に働いていた飲食店で働いていて、
2010年6月、不法就労（資格外活動）の罪で逮捕されました。

そして、私は、中国人4人に、
雇用する意思がないのに内容虚偽の雇用契約書を提供したから、
中国人4人は、技術や人文国際の在留資格が容易に得られた。

日本におられたので、不法就労が出来た。
よって、不法就労に対する刑法の幇助罪だとして逮捕されました。

私の主張は、

１．不法就労に対する幇助罪は入管法で、
働く資格のない外国人を働かせた者を73-2条（不法就労助長罪）で
刑事処分する規定をしているので、
不法就労とは何ら関係ない私に、
刑法の幇助罪を適用するのは不法だとの主張です。

２．不法就労させられた中国人4人が
刑事処分（懲役1年半、および罰金５０万円）されて、
不法就労させた事業者を何らお咎めなしで刑事処分しないのは、
恣意的に外国人を処罰することを禁じた国際法違反だとの主張です。

不法就労させたものが無罪であれば、
不法就労させられた中国人4人も無罪だとの主張です。

そして、不法就労が成立しないのであれば、
いかなる、不法就労に対する幇助者も存在しないという主張です。
したがって、私は、無罪です。

３．私に対して、刑法の幇助罪で刑事処分しました
（懲役1年半（実刑）及び罰金５０万円）しかし、
これは適用法違反です。

起訴状の訴因は、中国人4人はそれぞれが、
私の会社レフコ社から、内容虚偽の雇用契約書の提供をうけて
東京入管へ提出した事実と、
技術や人文国際の在留資格で、飲食店で働いた事実が記載されています。

仮に、雇用契約書が内容虚偽であるとしても、
記載している事実は、
入管法の22条の４－４（虚偽の書類の提出）に該当します。

22条の４－４の処罰は、法務大臣による、行政処分が下されます。
処分は在留資格の取り消しと国外退去処分です。
刑事処分ではありません。

入管法の訴因に記載されている事実が一般法である刑法より優先されますので、
私のしたことは、入管法の22条の４－４（虚偽の書類提出）の幇助行為に当たります。

国外退去の行政処分に対して、刑法の幇助罪を適用することはできません。

こういうことを言うと、
警察官は、「桜田門（警視庁のある場所）を舐めるんじゃねえ」
「一般論で認めろ」と言って、自白を強要します。

検察官は「私は偉いんです。私は貴方を懲役刑にでもできるんですよ」
「認めなさい」「認めなければ、私は、貴方の奥さんも逮捕できるんですよ」
「認めなさい。。。」

私は、美しい日本人でありたいと思います。
それで認めません。
検察官は、「もういい！刑務所に送ったる。。。」と言って、刑務所に送られました。

私は2010年6月に逮捕されました。
拘留期限がすぎても再逮捕されました。
警察署に留置されて取調べが毎日行われました。

2010年7月に起訴されました。
2010年8月には、東京拘置所に留置されました。
2010年10月末に東京地方裁判所で公判が開始されました。
2011年4月末に、懲役1年半、罰金50万万円の実刑でした。
即時に控訴をしました。
東京拘置所に留置されたままです。

2011年6月24日、やっと保釈されました。
逮捕されてから、毎月、保釈の申請をします。
しかし却下されます。東京高裁に特別抗告をします。しかし却下されます。
日本の司法は、罪を認めないと保釈さえしません。

2011年10月、東京高裁で控訴審が開かれますが、控訴棄却です。

私は、弁護士が信用できないので、弁護士とはべつに「上告趣意書」を作成します。
2011年11月末、最高裁判所に「上告趣意書」を提出します。
弁護士は12月に「上告趣意書」を提出。

2012年1月　最高裁より、上告棄却の通知がきます。
理由は、適用法違反の主張は、刑事訴訟法により、最高裁の審議事項ではない！

2012年2月　最高裁に対して「意義申立て」をします。
しかし、棄却の通知を受けます。

2012年3月5日　東京高検に出頭し、東京拘置所に受刑者として収監されます。

2012年４月5日　栃木県の黒金刑務所に移送されます。

2012年４　　　受刑者の待遇ﾋｱﾘﾝｸﾞで。仮出所のｾｯﾄをするが再審請求は口にするなと
　　　　　　　ｱﾄﾞﾊﾞｲｽされます。

2012年10月　　仮出所の面接がありますが、罪は認めません。

2012年11月仮出所を認めない通知を、刑務所幹部より受けます。
　　　　　　　仮面接を受けた者が仮出所にならないｹｰｽはまれなのです。

　　　　　　　刑務官より、ここの刑務官は、皆、長野は無罪だと言ってる
　　　　　　　今日の悔しさを忘れるな！

　　　　　　　なまじ、仮出所をすると、日本の司法制度は、
　　　　　　　あの時、罪を認めたじゃないかと言ううからな。

　　　　　　　俺は、お前が、仮出所できないことを喜んでいる！
　　　　　　　と言って慰めてくれます。

　　　　　　　一部の刑務官は、無罪なのにと思って、正月を自宅で過ごさせようと
　　　　　　　思って、仮出所の手続きをしてくれましたが、・・・・

　　　　　　　仮出所を認めるのは、原審（この事件では東京地裁）の裁判官です。
　　　　　　　裁判官は、私の出所を怖がっていたのです。

2013年3月10日　黒金刑務所を満期で。出所します。

出所後は、今日まで

警視庁、千葉県警察、東京地検、千葉地検、東京高検、最高検、
（メインは東京地検です・・・何度も、なんども）
法務省、外務省、総務省、警察庁、国家公安委員会、
最高裁、衆議院議長、参議院議長、
自民党はじめ各政党の代表および幹事長、全政党
全国会議員・・・
東京検察審査会１．２．３．４．５．６・・・・

他に、日本国内での努力すべき組織はあると言うのでしょうか

それで、国連人権高等弁務官事務所に何度も手紙やメールをしました
やっと帰ってきた答えが、
訴えは理解したが、国連人権高等弁務官事務所には、貴方の願いを、叶える権限がない。
日本は、個人の人権侵害を受け止める「個人通報制度」を批准してないので、
手伝えないとの返事でした。

それで、国際刑事裁判所（ICC）に訴え(情報提供)をしています。
このICCも、何の連絡もくれませんが、
何度も、メールで催促をしています。

国際社会で、人権問題を支援してくれる組織は、ＩＣＣありません。

私は、こうした、法の下での理不尽がテロを生んでいるのだと思います。
テロのない世界を作るには、法の下で世界が統治されなければなりません。

閣下にはICCへ、ICCのルール通りに、
刑事裁判をするように、要求してください。

世界は、金や軍事力で左右されるようになりました。
残念です。
大きな国も小さな国も、皆平等です。

国際社会のルールが守られて
テロに訴えなくても平和な世界が作られるように、
ICCを動かして下さい
