[Chapter 1] Case Overview

Autumn 2008: My company (where I serve as President) executed an employment contract with Chinese students holding student visas, promising to hire them upon their university graduation the following spring.


Late 2008: The Lehman Brothers bankruptcy triggered a global financial crisis, resulting in the abrupt cancellation of our upcoming system development projects.


2009: Due to the severe economic downturn, we were forced to rescind the job offers. Consequently, the graduated students had no choice but to continue working at the restaurants where they had been employed part-time during their studies.


May 2010: These former Chinese students were arrested for "Activities Other Than Those Permitted Under the Status of Residence" (Violation of Article 70 of the Immigration Control Act).


June 2010: I and our Chinese recruitment manager were also arrested. The charge brought against us was "Aiding and Abetting" (under the Penal Code) their unauthorized technical employment.


The Prosecution’s Logic: The prosecution asserted that our prior issuance of the employment contract constituted a "false document," which subsequently aided their unauthorized work.


[Chapter 2] Fatal Flaws in Judicial Interpretation

This indictment and subsequent judgment completely disregard fundamental legal principles, relying on an entirely arbitrary interpretation of the law.


Under Article 22-4, Paragraph 1, Item 4 of the Immigration Control Act at that time, submitting false documents merely granted the Minister of Justice the authority to revoke a residency status as an administrative disposition (leading to deportation). The act of submitting false documents itself was not codified as a criminal offense. Logically, one cannot be convicted of "aiding and abetting" an act that is not a crime in itself.


The court’s reasoning followed a convoluted chain of causality:


A residency status was obtained via a false employment contract.


The individuals resided in Japan based on that status.


Consequently, they engaged in unauthorized part-time work.


Therefore, the issuer of the initial contract aided and abetted the unauthorized work.


This is a far-fetched, flawed causal link that completely violates the principles of modern legal logic.


[My Argument]


Confusion of Administrative Dispositions and Criminal Penalties: The Immigration Control Act explicitly designates the consequences for false documentation as administrative measures (revocation of status and deportation). The legal process concludes there.


Absence of a Principal Offender: The actual employers of the restaurants where the students worked were never prosecuted for "Encouraging Illegal Employment" (Article 73-2 of the Immigration Control Act). Under the principle of equality under the law, it is a legal contradiction to punish us for aiding and abetting when the principal employers themselves were not prosecuted.


This same flawed legal doctrine was later improperly applied to diplomats and embassy staff.

I propose the establishment of "Special Economic Zones" designed to accept refugees and migrants as "temporary migrant workers," with their residency restricted to these designated zones.

【第1章】事件の概要

2008年秋: 私が経営する会社は、留学ビザで在留中だった中国人学生との間で、翌春の大学卒業後の採用を約束する「雇用契約書」を交付しました。


2008年末: リーマンショックが発生し、翌年以降のシステム開発案件が次々とキャンセルされました。


2009年: 経営環境の悪化により、やむを得ず該当の中国人学生の雇用を取り消しました。そのため、彼らは卒業後も学生時代からのアルバイト(飲食店)を継続せざるを得なくなりました。


2010年5月: この中国人元学生らが「在留資格外活動(入管法第70条違反)」で逮捕されました。


2010年6月: 私と採用担当者も逮捕されました。容疑は、彼らの資格外活動に対する「刑法上の幇助(手助け)罪」でした。


逮捕の論理: 検察側は、「過去に交付した雇用契約書が虚偽であり、それが結果的に彼らの不法就労を助けた」と主張したのです。


【第2章】判決における法解釈の致命的な誤り

この起訴および判決は、法律の原則を無視した極めて恣意的なものです。


当時の入管法第22条の4第4号の規定では、虚偽の書類を提出して在留資格を得た場合、法務大臣は「行政処分」としてその資格を取り消すことができると定めているに過ぎません。つまり、虚偽書類の提出そのものは、刑罰の対象となる「犯罪」とは規定されていません。犯罪ではない行為を「幇助」したという理屈は、法的に成立しません。


判決の論法は以下のようなものです。


虚偽の雇用契約書で在留資格を取得した。


その資格で日本に在留した。

Japan’s judicial system and immigration administration involve severe human rights violations that challenge international standards. Through my own experience, I strongly question Japan's status as a constitutional state governed by the rule of law.

[Chapter 1] Case Overview

Autumn 2008: My company (where I serve as President) executed an employment contract with Chinese students holding student visas, promising to hire them upon their university graduation the following spring.


Late 2008: The Lehman Brothers bankruptcy triggered a global financial crisis, resulting in the abrupt cancellation of our upcoming system development projects.


2009: Due to the severe economic downturn, we were forced to rescind the job offers. Consequently, the graduated students had no choice but to continue working at the restaurants where they had been employed part-time during their studies.


May 2010: These former Chinese students were arrested for "Activities Other Than Those Permitted Under the Status of Residence" (Violation of Article 70 of the Immigration Control Act).


June 2010: I and our Chinese recruitment manager were also arrested. The charge brought against us was "Aiding and Abetting" (under the Penal Code) their unauthorized technical employment.


The Prosecution’s Logic: The prosecution asserted that our prior issuance of the employment contract constituted a "false document," which subsequently aided their unauthorized work.


[Chapter 2] Fatal Flaws in Judicial Interpretation

This indictment and subsequent judgment completely disregard fundamental legal principles, relying on an entirely arbitrary interpretation of the law.


Under Article 22-4, Paragraph 1, Item 4 of the Immigration Control Act at that time, submitting false documents merely granted the Minister of Justice the authority to revoke a residency status as an administrative disposition (leading to deportation). The act of submitting false documents itself was not codified as a criminal offense. Logically, one cannot be convicted of "aiding and abetting" an act that is not a crime in itself.


The court’s reasoning followed a convoluted chain of causality:


A residency status was obtained via a false employment contract.


The individuals resided in Japan based on that status.


Consequently, they engaged in unauthorized part-time work.


Therefore, the issuer of the initial contract aided and abetted the unauthorized work.


This is a far-fetched, flawed causal link that completely violates the principles of modern legal logic.


[My Argument]


Confusion of Administrative Dispositions and Criminal Penalties: The Immigration Control Act explicitly designates the consequences for false documentation as administrative measures (revocation of status and deportation). The legal process concludes there.


Absence of a Principal Offender: The actual employers of the restaurants where the students worked were never prosecuted for "Encouraging Illegal Employment" (Article 73-2 of the Immigration Control Act). Under the principle of equality under the law, it is a legal contradiction to punish us for aiding and abetting when the principal employers themselves were not prosecuted.


This same flawed legal doctrine was later improperly applied to diplomats and embassy staff.

Part 3: A New Business Model via Special Economic Zones

I propose the establishment of "Special Economic Zones" designed to accept refugees and migrants as "temporary migrant workers," with their residency restricted to these designated zones.

【第1章】事件の概要

2008年秋: 私が経営する会社は、留学ビザで在留中だった中国人学生との間で、翌春の大学卒業後の採用を約束する「雇用契約書」を交付しました。


2008年末: リーマンショックが発生し、翌年以降のシステム開発案件が次々とキャンセルされました。


2009年: 経営環境の悪化により、やむを得ず該当の中国人学生の雇用を取り消しました。そのため、彼らは卒業後も学生時代からのアルバイト(飲食店)を継続せざるを得なくなりました。


2010年5月: この中国人元学生らが「在留資格外活動(入管法第70条違反)」で逮捕されました。


2010年6月: 私と採用担当者も逮捕されました。容疑は、彼らの資格外活動に対する「刑法上の幇助(手助け)罪」でした。


逮捕の論理: 検察側は、「過去に交付した雇用契約書が虚偽であり、それが結果的に彼らの不法就労を助けた」と主張したのです。


【第2章】判決における法解釈の致命的な誤り

この起訴および判決は、法律の原則を無視した極めて恣意的なものです。


当時の入管法第22条の4第4号の規定では、虚偽の書類を提出して在留資格を得た場合、法務大臣は「行政処分」としてその資格を取り消すことができると定めているに過ぎません。つまり、虚偽書類の提出そのものは、刑罰の対象となる「犯罪」とは規定されていません。犯罪ではない行為を「幇助」したという理屈は、法的に成立しません。


判決の論法は以下のようなものです。


虚偽の雇用契約書で在留資格を取得した。


その資格で日本に在留した。


在留した結果、アルバイト(資格外活動)を行った。


したがって、最初の契約書を出した者が資格外活動を幇助した。

Japan’s judicial system and immigration administration involve severe human rights violations that challenge international standards. Through my own experience, I strongly question Japan's status as a constitutional state governed by the rule of law.

[Chapter 1] Case Overview

Autumn 2008: My company (where I serve as President) executed an employment contract with Chinese students holding student visas, promising to hire them upon their university graduation the following spring.


Late 2008: The Lehman Brothers bankruptcy triggered a global financial crisis, resulting in the abrupt cancellation of our upcoming system development projects.


2009: Due to the severe economic downturn, we were forced to rescind the job offers. Consequently, the graduated students had no choice but to continue working at the restaurants where they had been employed part-time during their studies.


May 2010: These former Chinese students were arrested for "Activities Other Than Those Permitted Under the Status of Residence" (Violation of Article 70 of the Immigration Control Act).


June 2010: I and our Chinese recruitment manager were also arrested. The charge brought against us was "Aiding and Abetting" (under the Penal Code) their unauthorized technical employment.


The Prosecution’s Logic: The prosecution asserted that our prior issuance of the employment contract constituted a "false document," which subsequently aided their unauthorized work.


[Chapter 2] Fatal Flaws in Judicial Interpretation

This indictment and subsequent judgment completely disregard fundamental legal principles, relying on an entirely arbitrary interpretation of the law.


Under Article 22-4, Paragraph 1, Item 4 of the Immigration Control Act at that time, submitting false documents merely granted the Minister of Justice the authority to revoke a residency status as an administrative disposition (leading to deportation). The act of submitting false documents itself was not codified as a criminal offense. Logically, one cannot be convicted of "aiding and abetting" an act that is not a crime in itself.


The court’s reasoning followed a convoluted chain of causality:


A residency status was obtained via a false employment contract.


The individuals resided in Japan based on that status.


Consequently, they engaged in unauthorized part-time work.


Therefore, the issuer of the initial contract aided and abetted the unauthorized work.


This is a far-fetched, flawed causal link that completely violates the principles of modern legal logic.


[My Argument]


Confusion of Administrative Dispositions and Criminal Penalties: The Immigration Control Act explicitly designates the consequences for false documentation as administrative measures (revocation of status and deportation). The legal process concludes there.


Absence of a Principal Offender: The actual employers of the restaurants where the students worked were never prosecuted for "Encouraging Illegal Employment" (Article 73-2 of the Immigration Control Act). Under the principle of equality under the law, it is a legal contradiction to punish us for aiding and abetting when the principal employers themselves were not prosecuted.


This same flawed legal doctrine was later improperly applied to diplomats and embassy staff.

Part 3: A New Business Model via Special Economic Zones

I propose the establishment of "Special Economic Zones" designed to accept refugees and migrants as "temporary migrant workers," with their residency restricted to these designated zones.

[Chapitre 1] Aperçu de l'affaire


Automne 2008 : Mon entreprise (dont je suis le président) a signé un contrat de travail avec des étudiants chinois titulaires de visas d'études, leur promettant une embauche à l'issue de l'obtention de leur diplôme universitaire au printemps suivant.

Mai 2010 : Ces anciens étudiants chinois ont été arrêtés pour « Activités autres que celles autorisées par le statut de résident » (violation de l’article 70 de la loi sur le contrôle de l’immigration).


Juin 2010 : Mon responsable du recrutement chinois et moi-même avons également été arrêtés. Nous avons été accusés de « complicité » (en vertu du Code pénal) de leur emploi technique illégal.


Argumentaire de l’accusation : L’accusation a soutenu que la délivrance préalable de notre contrat de travail constituait un « faux document », facilitant ainsi leur travail illégal.


[Chapitre 2] Erreurs fatales d'interprétation judiciaire


L'acte d'accusation et le jugement subséquent méconnaissent totalement les principes juridiques fondamentaux, s'appuyant sur une interprétation entièrement arbitraire de la loi.


Aux termes de l'article 22-4, paragraphe 1, point 4 de la loi sur le contrôle de l'immigration en vigueur à l'époque, la production de faux documents autorisait uniquement le ministre de la Justice à révoquer un titre de séjour par mesure administrative (entraînant une expulsion). Le fait de produire de faux documents n'était pas en soi une infraction pénale. Logiquement, on ne peut être condamné pour « complicité » d'un acte qui n'est pas un crime en soi.


Le raisonnement du tribunal repose sur une chaîne de causalité alambiquée :


Un titre de séjour a été obtenu grâce à un faux contrat de travail.


Les personnes concernées ont résidé au Japon grâce à ce titre.


Par conséquent, elles ont exercé un travail à temps partiel non autorisé.


Dès lors, l'auteur du contrat initial s'est rendu complice de ce travail illégal.


Il s'agit d'un lien de causalité tiré par les cheveux et fallacieux, qui viole totalement les principes de la logique juridique moderne.


[Mon argument]


Confusion entre mesures administratives et sanctions pénales : La loi sur le contrôle de l'immigration désigne explicitement les conséquences de la falsification de documents comme des mesures administratives (révocation du statut et expulsion). La procédure légale s'arrête là.


Absence d'auteur principal : Les employeurs des restaurants où travaillaient les étudiants n'ont jamais été poursuivis pour « incitation au travail illégal » (article 73-2 de la loi sur le contrôle de l'immigration). En vertu du principe d'égalité devant la loi, il est juridiquement contradictoire de nous punir pour complicité alors que les employeurs principaux n'ont pas été poursuivis.


Cette même doctrine juridique erronée a ensuite été appliquée à tort à des diplomates et au personnel des ambassades.

Part 2: The Immigration Control Act Violation Case [Weekday Edition]

Japan’s judicial system and immigration administration involve severe human rights violations that challenge international standards. Through my own experience, I strongly question Japan's status as a constitutional state governed by the rule of law.

[Chapter 1] Case Overview

Autumn 2008: My company (where I serve as President) executed an employment contract with Chinese students holding student visas, promising to hire them upon their university graduation the following spring.


Late 2008: The Lehman Brothers bankruptcy triggered a global financial crisis, resulting in the abrupt cancellation of our upcoming system development projects.


2009: Due to the severe economic downturn, we were forced to rescind the job offers. Consequently, the graduated students had no choice but to continue working at the restaurants where they had been employed part-time during their studies.


May 2010: These former Chinese students were arrested for "Activities Other Than Those Permitted Under the Status of Residence" (Violation of Article 70 of the Immigration Control Act).


June 2010: I and our Chinese recruitment manager were also arrested. The charge brought against us was "Aiding and Abetting" (under the Penal Code) their unauthorized technical employment.


The Prosecution’s Logic: The prosecution asserted that our prior issuance of the employment contract constituted a "false document," which subsequently aided their unauthorized work.


[Chapter 2] Fatal Flaws in Judicial Interpretation

This indictment and subsequent judgment completely disregard fundamental legal principles, relying on an entirely arbitrary interpretation of the law.


Under Article 22-4, Paragraph 1, Item 4 of the Immigration Control Act at that time, submitting false documents merely granted the Minister of Justice the authority to revoke a residency status as an administrative disposition (leading to deportation). The act of submitting false documents itself was not codified as a criminal offense. Logically, one cannot be convicted of "aiding and abetting" an act that is not a crime in itself.


The court’s reasoning followed a convoluted chain of causality:


A residency status was obtained via a false employment contract.


The individuals resided in Japan based on that status.


Consequently, they engaged in unauthorized part-time work.


Therefore, the issuer of the initial contract aided and abetted the unauthorized work.


This is a far-fetched, flawed causal link that completely violates the principles of modern legal logic.


[My Argument]


Confusion of Administrative Dispositions and Criminal Penalties: The Immigration Control Act explicitly designates the consequences for false documentation as administrative measures (revocation of status and deportation). The legal process concludes there.


Absence of a Principal Offender: The actual employers of the restaurants where the students worked were never prosecuted for "Encouraging Illegal Employment" (Article 73-2 of the Immigration Control Act). Under the principle of equality under the law, it is a legal contradiction to punish us for aiding and abetting when the principal employers themselves were not prosecuted.


This same flawed legal doctrine was later improperly applied to diplomats and embassy staff.

Part 3: A New Business Model via Special Economic Zones

I propose the establishment of "Special Economic Zones" designed to accept refugees and migrants as "temporary migrant workers," with their residency restricted to these designated zones.


This framework offers a dual benefit: advanced nations secure low-cost labor to drive economic growth, while migrants receive human dignity, secure jobs, and free access to housing, food, healthcare, and education.

9 【未加盟国に対する権限不行使の原則】米国、イスラエル、ロシアなど、ローマ規程に加盟していない主要国に対して、ICCが直接管轄権を行使することは法理的に矛盾しています。これが、国家主権と条約の相対効を定めた国際法の基本原則です。(長野恭博)


10 【ICCによる「例外論」の展開】しかし現実のICCは、非加盟国に対する捜査において「例外」を持ち出し、管轄権を主張しています。その代表例が、犯罪が加盟国の領域内で発生したとする「領域管轄」の適用や、非加盟国が独自に行う「ad hoc(臨時の)宣言」の利用です。(長野恭博)

12 【ad hoc宣言の本質的矛盾】非加盟国によるad hoc宣言は、あくまでその国自身の政治的・一時的な判断によるものであり、国際社会全体の普遍的な条約同意とは性質が異なります。これを根拠に第三国籍の個人へ義務を拡張することは、条約法の体系を潜脱する行為に等しいと言えます。(長野恭博)


13 【米国の批判の正当性】こうした観点から見れば、ICCの例外論は第34条の原則を事実上骨抜きにするものであり、米国の法的批判は国際法秩序の観点から見て極めて正当な主張であると言わざるを得ません。(長野恭博)

第2部:「入管法違反事件」【平日版】

日本の司法制度および入管行政には、国際社会の基準から見ても極めて重大な人権侵害の疑いがあります。私は自身の経験を通じて、日本の「法治国家」としてのあり方に強い疑問を投げかけます。

【第1章】事件の概要

2008年秋: 私が経営する会社は、留学ビザで在留中だった中国人学生との間で、翌春の大学卒業後の採用を約束する「雇用契約書」を交付しました。


2008年末: リーマンショックが発生し、翌年以降のシステム開発案件が次々とキャンセルされました。


2009年: 経営環境の悪化により、やむを得ず該当の中国人学生の雇用を取り消しました。そのため、彼らは卒業後も学生時代からのアルバイト(飲食店)を継続せざるを得なくなりました。


2010年5月: この中国人元学生らが「在留資格外活動(入管法第70条違反)」で逮捕されました。


2010年6月: 私と採用担当者も逮捕されました。容疑は、彼らの資格外活動に対する「刑法上の幇助(手助け)罪」でした。


逮捕の論理: 検察側は、「過去に交付した雇用契約書が虚偽であり、それが結果的に彼らの不法就労を助けた」と主張したのです。


【第2章】判決における法解釈の致命的な誤り

この起訴および判決は、法律の原則を無視した極めて恣意的なものです。


当時の入管法第22条の4第4号の規定では、虚偽の書類を提出して在留資格を得た場合、法務大臣は「行政処分」としてその資格を取り消すことができると定めているに過ぎません。つまり、虚偽書類の提出そのものは、刑罰の対象となる「犯罪」とは規定されていません。犯罪ではない行為を「幇助」したという理屈は、法的に成立しません。


判決の論法は以下のようなものです。


虚偽の雇用契約書で在留資格を取得した。


その資格で日本に在留した。


在留した結果、アルバイト(資格外活動)を行った。


したがって、最初の契約書を出した者が資格外活動を幇助した。


これは「風が吹けば桶屋が儲かる」式の強引な因果関係であり、近代法の論理に完全に反しています。


【私の主張】


行政処分と刑事罰の混同: 入管法は、虚偽書類に対する措置を行政処分(在留資格の取消・強制送還)と定めており、それで手続きは完結します。


正犯なき幇助の矛盾: 彼らが働いていた飲食店の雇用主は、入管法第73条の2(不法就労助長罪)で処罰されていません。正犯(実際の雇用主)が処罰されていない以上、法の下の平等の原則に照らし、私たちが処罰されるのは法理的に異常です。


同様の不当な論理は、のちに外交官や大使館職員に対しても適用されることになります。

第3部:特区建設による新たなビジネスモデル

難民や移民を「一時的移民労働者」として受け入れ、居住エリアを限定した「特区」を建設する提言です。


先進国にとっては低賃金労働力の確保による経済成長、移民にとっては衣食住・医療・教育が無料で保障された人間らしい生活の場となります。双方にメリットのある現実的な解決策です。

Chapter 7: When I was released from prison after completing my sentence, I read the newspaper and found out that a similar incident had occurred at the Philippine Embassy.

Philippine diplomats, embassy staff, and Filipino drivers have suffered the same damage as me.


I have also filed a criminal accusation against this case.


I and the Chinese in the 2010 immigration law violation case, and the Philippine Embassy staff and diplomats in 2013, were punished for the same reason.


I have submitted my complaint and the complaints of the Chinese and Filipinos to the Tokyo District Public Prosecutors Office, the Tokyo High Public Prosecutors Office, and the Supreme Public Prosecutors Office.


However, all of them were rejected. If the prosecutor accepts and rejects the case, I can request the Prosecutor's Review Board to prosecute, but I have no way to oppose the rejection.


I also appealed to political parties and Diet members. But they were all ignored.


A city council member accompanied me to the Democratic Party's legal advisor. However, the advisor's answer was that if the "principal offense" is found guilty, then the "crime of aiding and abetting" is established. Is he really a lawyer?


The Democratic Party's legal advisor says that all those who graduated from the Legal Training and Research Institute have the same answer. This is proof that Japan is not "governed under the law".


I asked the Japan Bar Association for support. They said that the JFBA does not have the "power" to solve the problem. Japan's "judicial system" is crazy.


I have "emailed" "political parties and Diet members", as well as "the Prime Minister's Office and the Human Rights Bureau" on "Facebook and (X)", but they are still ignoring me.


This case is an arbitrary misapplication of the law by police officers, prosecutors, and judges. (It is an illegal act).


The charges are "Abuse of the authority of a special public official" and "Crimes of False Complaints".


In my "personal opinion," the prosecutors "concealed" the "criminal complaint" and "criminal accusation" by their "authority." Therefore, the "statute of limitations" has been suspended.


"Chapter 8." This case is "legally" an "error in the application of law."

"Errors in the application of law" are not subject to "requests for retrial" under the "Criminal Procedure Law."


However, if the "crime of the inspectors and police officers involved in the case" is "proven," a request for retrial can be made.


1. The charge against the "special public officials" in this case is "abuse of the authority of special public officials."

They "arrested" us even though there was "no suspicion of a crime." And they even "detained" us. (There is a precedent for grand jury decisions.)

2. And it is "the crime of false accusation." It is a fact that they "indicted" us and even found us guilty in a "trial" in order to make us criminals.


Requests for retrial can be made by us or by the prosecutors.

I believe that the prosecution should admit guilt and make a request for a retrial.


I will not give up. It has been 15 years since the incident.


The only country that can resolve this case is the United States.

When Trump was the former president, he promised me.


He replied with a signed letter saying, "I will resolve this in a way that satisfies you."


I hope that this time he will keep his promise.


President Trump, let's work together to "revive the Rust Belt" and create a "special zone on the Mexican border."


And let's cross the Caribbean Sea to the Pacific Ocean in two hours with the "American Linear Canal Railway," a freight train dedicated to containers that will replenish the Panama Canal.
