罪名は、特別「公務員職権乱用罪」および「虚偽告訴罪」です。

第１部。私は、2つのことを「訴えて」います。

私は、私のみならず中国人やフィリッピン人だけでなく、世界の多くの犠牲者のために戦っています。

１．外国人が「在留の資格」以外の「違法な労働」を行った。

しかし外国人は「無罪」です。

外国人だけが入管法７０条「違法な労働の罪」で処罰されました。

これに対して、入管法は不法な労働の「因果関係」である雇用者を入管法７３－２条の（不法な就労を助長した罪）で処罰する規定です。

しかし外国人を「違法に雇用した者」を「処罰」していない。

これは明らかに日本国憲法14条「法の下での平等の原則」に反します。

そして「意識的」に外国人だけを「処罰」することを禁じた国際法に違反しています。

違法に外国人を雇用した雇用者が「無罪」であるならば、違法に働かされた外国人も「無罪」です。

この被害者は「膨大な数」です。

中国人や韓国人は、特に多い。

２．検察は「入管法22-4-4条の支援」を理由として、入管法70条に対して刑法の60条および62条の「他の犯罪を支援する罪」を「適用」したが「適用する法律の誤り」です。

「入管法22-4-4条」は虚偽申請によって在留資格を取得した者の処分です。

従来、入管法は、虚偽申請によって在留資格を取得した者について、罰則の対象ではありませんでした（旧法７０条、７４条の６）。

虚偽申請によって在留資格を取得した者、これを幇助した勤務先、弁護士、行政書士及び学校職員等の申請取次者を罰則の対象とした改正入管法が第１９２回臨時国会において成立しました。「２０１７年１月１日から施行」されています。

「私、KinGungaku、フィリッピン国の外交官、フィリッピン大使館職員」は１００％「無罪」です。

2017年1月の入管法の改正で「私は無罪」であることが改正理由で述べています。理由：「処罰できない」から「処罰できる」ように改正する。

「冤罪」です。国際社会の皆様ありがとうございました。しかし日本政府はまだ謝罪をしません。起訴状は下記でご覧ください。（日本語）

不法就労で在留資格以外で収入を得た外国人は入管法70条違反です。

しかし入管法は、不法就労をさせた事業者を入管法73－2条で処罰しています。

しかし、不法に働かせた事業者を処罰せずに外国人だけを恣意的に処罰するのは国際法違反です。

よって、法の論理で不法に働かされた外国人は無罪です。

被害者は、告発状の記載の以外に、大勢の外国人です。

日本政府は「人権条約」を守る義務があります。

※基本的な法律に基づかない「逮捕・監禁」

※外国人を「恣意的に処罰する行為」

私だけでなく多くの外国人が日本の司法の犠牲になっています。
